Attention all applicants seeking building permits for new structures, substantial repairs and/or renovations in excess of 50 percent in FEMA designated flood zones: The revised FEMA Flood Insurance Rate Map (FIRM) and base flood elevation requirements for construction in designated flood zones went into effect on September 11, 2009. All building permits issued on or after the effective date of the new Flood Insurance Rate Maps must demonstrate compliance with the new requirements, without exception. Additionally, all permits issued prior to September 11, 2009 that have not substantially commenced construction by 9/11/09 will also need to comply with the new regulations. (In general, substantial commencement of construction refers to a complete foundation being in place.)
It is the responsibility of the applicant and design professional to coordinate and schedule the timely filing of permit applications to ensure that applications in the process of review are completed prior to the enactment of the new requirements. Additionally, the revised FIRM utilizes North American Vertical Datum to establish all base flood elevations. As such, all surveys submitted for proposed construction in a flood zone must note and indicate the use of North American Vertical Datum as the data used to establish elevations.
